Summary: The $1,500 setup fee is non-refundable once build work begins (within 48h of payment). Monthly retainers (Managed $1,000/mo, Growth $2,500/mo) are non-refundable for the current billing period but cancel-anytime with 7 days notice. Month 2 is protected by our 30-Day Improvement Guarantee on the Managed plan. All payments via Xflow (ACH bank transfer).
1. One-Time Setup Fee ($1,500)
The setup fee covers real operator time and enrichment costs incurred on your behalf: Clay waterfall table construction, Apollo + Hunter + Prospeo enrichment across 500 leads, Instantly campaign configuration with domain warmup, AI-personalized opener writing, and a 20-minute Loom walkthrough delivery. Because this work begins within 48 hours of payment:
- Setup fee is fully refundable only if Client cancels before any build work begins (i.e., before Breculia AI starts Clay table construction or Instantly campaign setup)
- Setup fee is non-refundable once build work has started, even if Client later decides not to use the system
- To request a pre-build cancellation refund, email founder@breculia.tech within 4 hours of payment with subject: Setup Cancellation — [Business Name]
2. Monthly Retainer Fees
- Monthly retainers are non-refundable once a billing period has started
- Cancellation: Submit written notice at least 7 days before next billing date to stop future charges. Service continues through the end of the current paid period.
- Exception — Verified Service Failure: If Breculia AI fails to deliver the agreed weekly outputs (lead list refresh, copy updates, performance report) for 2+ consecutive weeks due to operator fault, a prorated credit is issued toward the next billing cycle
- Platform outages on Clay, Instantly, Apollo, Hunter, or Prospeo are outside Breculia AI's control and do not qualify for refunds or credits
2A. 30-Day Improvement Guarantee (Managed Plan Only)
If the outbound system delivers fewer than 5 positive replies within the first 30 calendar days of campaign go-live, you may request Month 2 at no charge. To qualify:
- Submit written request to founder@breculia.tech within 30 days of go-live date
- Use subject line: Improvement Guarantee — [Business Name]
- Client must have maintained active Clay Growth and Instantly accounts throughout the 30-day period
- Low reply count must not result from Client changes to ICP, pausing campaigns, or domain configuration errors on Client's side
- Breculia AI will verify Instantly campaign stats within 3 business days
- If approved, Month 2 management fee is waived (applied as credit or invoice cancellation)
3. What Qualifies for a Refund or Credit
- Setup fee cancellation before build work begins (within ~4 hours of payment)
- Month 2 retainer waiver under the 30-Day Improvement Guarantee (Managed plan)
- Prorated billing credit for verified consecutive operator-side delivery failure (2+ weeks)
- Duplicate payments — 100% refunded immediately upon confirmation via Xflow
4. What Does Not Qualify for a Refund
- Setup fee once Clay table build or Instantly campaign setup has begun
- Monthly retainers for the current billing period (no refund for partial months or mid-cycle cancellations)
- Low reply rates caused by ICP misalignment, saturated audiences, or market timing — these are external factors outside Breculia AI's control
- Platform outages on Clay, Instantly, Apollo, Hunter, Prospeo, or Smartlead
- Change of mind after delivery of system build and Loom walkthrough
- Dissatisfaction with meeting volume or revenue outcomes — Breculia AI optimizes the system but does not guarantee specific business results
5. How to Request a Refund
Email founder@breculia.tech with subject line "Refund Request — [Your Business Name]" and include your Xflow transaction reference and a brief description of the issue. We respond within 2 business days. Approved refunds are processed within 7 business days via Xflow ACH refund to the originating bank account.
6. Disputes & Chargebacks
If you believe you have been charged incorrectly, please contact founder@breculia.tech before initiating a dispute through your bank or Xflow. We resolve all billing disputes promptly — most within 2 business days.
ACH disputes initiated without prior written communication to Breculia AI will result in immediate service suspension. Any Xflow processing or reversal fees incurred due to a retracted, failed, or fraudulent ACH dispute are the responsibility of the client.
This policy is governed by the laws of India (Chennai, Tamil Nadu). For US clients, disputes follow the resolution process outlined in the Terms & Conditions.
